Seller Agreement

This Seller Agreement (the "Agreement") governs your sale of items on Artisans Paradise and is between you ("you" or "Seller") and Artisans Paradise LLC ("Artisans Paradise," "we," or "us"). It supplements and incorporates our Terms of Service (including its arbitration agreement, governing-law, disclaimer, and limitation-of-liability provisions), Privacy Policy, Prohibited & Restricted Items Policy, and Buyer Protection & Refund Policy. If this Agreement conflicts with the Terms of Service on a seller-specific matter, this Agreement controls for that matter.

1. Becoming a Seller

You become a Seller by creating a Seller account, accepting this Agreement, and completing payment onboarding — including identity, bank, and tax verification — through our payment processor. There is no separate application or approval step and no waiting period; you may begin listing once onboarding is complete. "Verified artisan" and similar indicators are badges you can earn over time by passing our identity and craft review — recognition, not a precondition to selling. You must be at least 18. We may decline, restrict, suspend, or remove Seller access at our discretion to enforce this Agreement or protect Buyers and the Service. You must re-accept any updated version of this Agreement before continuing to sell.

2. Your Relationship with Us

You are an independent seller and independent contractor. Nothing in this Agreement creates an employment, agency, partnership, or joint-venture relationship. You sell your items directly to Buyers; Artisans Paradise is a marketplace and venue and a limited payments, shipping-label, and tax facilitator, and is not the seller, manufacturer, importer, or distributor of your items.

3. Your Listings and Content

You are solely responsible for your listings, including accurate titles, descriptions, photos, materials, condition, pricing, and the processing / shipping time you set for each item. You must own or have the rights to your content, and you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, promote, and feature your listings and related content across the Service and our marketing channels. You may not include content or contact details intended to divert transactions off-platform.

4. Handmade and Authenticity

Every item must be designed and meaningfully crafted by you or your clearly identified studio, and accurately described. Resold, mass-produced, or drop-shipped goods, and AI-generated work without substantial human craftsmanship, are not permitted. Misrepresenting handmade or artisan items is grounds for removal, payout hold, and termination.

5. Prohibited and Regulated Items

You may not list anything barred by our Prohibited & Restricted Items Policy, and for regulated categories (such as cosmetics, soap, candles, food, children's products, and electrical items) you must comply with all applicable product-safety, labeling, and licensing laws and provide proof of compliance on request. Listing prohibited items or non-compliant regulated items is grounds for removal and possible termination.

6. Orders, Processing Times, and Shipping

You set the processing / ship-by time for each item, which is shown to the Buyer before purchase. You must ship within that time, package items safely, and upload valid tracking to the order before or at dispatch; we provide EasyPost label generation and tracking. Shipping late (relative to the time you set) harms your shipping score and buyer trust, and we may take action — including reduced visibility, warnings, payout holds, suspension, or termination — for repeated or serious lateness. Risk of loss passes according to your shipping terms and applicable law.

7. Commission, Fees, and Payouts

Artisans Paradise charges a flat 8% commission on the final price of every sale (auction win, Buy Now, or stocked product); you also bear the payment-processing fees charged by our payment processor and receive the remainder. Payouts are issued via Stripe Connect, net of commissions, fees, refunds, chargebacks, and amounts you owe us, and may be delayed, held, or reserved to manage risk. The full details of fees, payouts, holds, reserves, and taxes are in our Fees & Payments Policy, which is part of these Terms; we may change fees prospectively as described there.

8. Refunds, Claims, and Chargebacks

You must honor our Buyer Protection & Refund Policy and respond promptly to claims with the evidence we request. You fund approved refunds; we may advance a refund to the Buyer and recover it from your payouts or reserve. You bear the cost of chargebacks except where they result from our error, and you authorize us to deduct or recover refunds, chargebacks, and related fees from your balance. Disputes and claims are surfaced on your seller dashboard for response.

9. Taxes

Where required by law, Artisans Paradise acts as a marketplace facilitator and collects and remits transaction taxes on covered sales; otherwise you are responsible for those taxes, as described in our Fees & Payments Policy. You are an independent contractor responsible for your own income and business taxes and any tax registrations that apply to you; we may issue tax forms (for example, IRS Form 1099-K) and report earnings where required.

10. Product Responsibility, Liability, and Insurance

As between you, Artisans Paradise, and the Buyer, you are the seller and producer of your items and are solely responsible and liable for them. You represent and warrant that your items are safe, lawful to sell and ship, accurately described, not recalled or banned, and compliant with all applicable product-safety, labeling, and consumer-protection laws. You assume all liability arising from your items, including product defects, failure to warn, personal injury, illness, death, property damage, and regulatory violations. You are solely responsible for deciding whether to carry, and for obtaining, any product-liability or business insurance for the products you sell; we do not require or verify insurance.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Artisans Paradise LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your items, listings, content, or conduct, your violation of this Agreement or any law, or any claim that your items caused injury, illness, death, property damage, defect, recall, or regulatory harm, whether brought by a Buyer or any other person.

12. Suspension, Payout Holds, and Termination

We may suspend or terminate your selling privileges, remove listings, and hold or reverse payouts related to disputed, fraudulent, or non-compliant activity, with or without notice, for breach of this Agreement, the Terms of Service, or applicable law, or to protect Buyers or the Service. Either party may terminate with notice; you remain responsible for open orders, refunds, chargebacks, and amounts owed. Provisions that by their nature should survive termination will survive.

13. Changes to This Agreement

We may update this Agreement; the effective date appears at the top of this page. You will be required to re-acknowledge material changes before continuing to sell.
